III. TERMS AND CONDITIONS
1. DISCOUNTS ON SERVICE, MONEY BACK GUARANTEE
A. Under the terms of this agreement, customer may be given a discount on the initial service fee in exchange for an agreement to receive and pay for service for at least one year. If a discount was applied to the initial service and customer cancels prior to fulfilling the minimum obligation of one year, for any reason, customer agrees to pay an early termination fee of up to 75% of the remaining contract value ($75 minimum). If cancellation occurs during the 72 hour right of recession clause, customer agrees that they may be required to pay the full cost of the initial service, as quoted on the service contract, before promotional discounts are applied.
B. Money Back Guarantee- To be eligible for a credit of your last service payment, re-treatments must qualify as outlined. Qualifying retreatments are defined as: return service requests for COVERED PESTS only and not for pests determined EXTENDED COVERAGE or ADDITIONAL COST. Pests in those categories do not have the same guarantee. For COVERED PESTS re-treatments to be eligible are for infestations that must be of the same pest and found in the same location INSIDE the home. You must make this request in a timely manner, while you are between regular services only, and after 2 (two) consecutive retreatments. If these requirements are met, you may request your last service payment to be credited to your account. TriGuard will then make arrangements to return to your home to verify problem conditions. Upon verification of a persisting problem, a credit of your last service payment will be placed on your account the following day.
You the buyer, may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction unless services have already been completed.
2. FUTURE DAMAGE, LIMITATION OF LIABILITY
A. This agreement does not provide for the control of prevention of termites, powder post beetles, wood borers, wood wasps, wood decay fungus, or any other pest not indicated herein. I expressly waive and release TriGuard Pest Control from liability for any claim for personal injury or damage to the structure or its contents caused by wood infesting organisms, carpenter ants, carpenter bees, fire ants, pharaoh ants, spiders, ticks, fleas, wasps, bees, scorpions or other pests listed on this contract.
3. DISCLAIMER
A. TriGuard’s liability under this agreement will be terminated if TriGuard is prevented from fulfilling its responsibilities by reason of delays in transportation, shortages of fuel and or material, strikes, embargoes, fire, floods, quarantine restrictions, earthquakes, hurricanes or other act of God or circumstances or cause beyond the control of TriGuard.
B. TRIGUARD DISCLAIMS ANY LIABILITY FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES. THE GUARANTEES STATED IN THIS AGREEMENT ARE GIVEN OF MERCHANT ABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
C. TriGuard is not liable for any pre-existing or future damage caused by rodents in the attic, crawlspace or any other part of the customer’s property.
D. TriGuard is not liable if humans, pets or non-targeted animals get into bait stations and consume rodenticide. TriGuard is not liable if humans, pets or non-targeted animals consume rodenticide that may have been secured in the attic, the crawlspace or any other part of the property.
E. TriGuard is not liable for any harm to humans, pets and property from the products used.
4. LATE PAYMENT
Payment is due at the time of service. If the customer fails, for any reason, to make payment within 30 days from the due date, TriGuard, at its option may discontinue service and start collection proceedings. Upon failure to make such payments, the customer agrees to pay the cost of the collection amount of $75.00. A charge of 1 ½ percent per month, will be added to past due accounts. A $35.00 fee will be charged on any returned checks. Customers agree that credit card and ACH disputes with the bank will result in a fee of $25.00 per dispute/chargeback requests, unless charges were processed in duplicate or error by TriGuard.
UPON REQUEST, TRIGUARD WILL SUPPLY THE PURCHASER WITH A COPY OF THE MANUFACTURER’S SPECIMEN LABEL OF PESTICIDES WHICH WILL BE USED TO TREAT THE PREMISES
